Gary Don Boyd Graves, 32, of Lubbock appeared Wednesday in federal court. He pleaded not guilty to possession of pre-pubescent child pornography.
A federal magistrate decided that under the right circumstances Graves could be released from jail until his trial date. The date was tentatively set at August 14.
However, before Graves can be released, there must be a suitable third-party custodian. For now, he remains in custody since his arrest on June 15.
A police report said his girlfriend called police in February when she found sexual images of children on his cell phone.
