A lawsuit was filed in late November against 1500 Broadway Partners, and McDougal Realtors. On Wednesday the defendant, 1500 Broadway Partners responded in court records.
Donna Rosencranse claimed that she leased 3,500 square feet in August. She claimed in her lawsuit that defendants failed to repair and maintain the grease trap, and complete other repairs “for which [the] landlord was responsible.”
She also claimed she was never told by the defendants that the building was under investigation by the city for possible safety code violations. Rosencranse claimed she got stuck with $71,931.47 of repairs. She wants the defendants to pay her back.
1500 Broadway Partners said in its response that Rosencranse is responsible for repairing and maintaining the grease trap.
1500 Broadway Partners also said in court records, “[Her] claims are barred by the terms of the lease itself, to wit: if the space is not usable per government regulations then neither party is liable to the other.”
According to LinkedIn, Rosencranse is the owner of a local restaurant and catering service.
The proposed restaurant on the 14th floor of the building had not opened as of Wednesday.
