Court papers said a Dick’s Sporting Goods employee denied the sale of a gun to beleaguered Rochester, NY City Court Judge Leticia Astacio because she was acting “distraught.”

Astacio was arrested Monday for the incident on April 2. According to court papers, Astacio tried to buy a shotgun at two locations — Greece and Henrietta.

A Dick’s manager said Astacio first went to the Greece store to buy a gun but was denied the sale. The manager in Greece said Astacio seemed “distraught” and “upset,” adding employees weren’t comfortable making the sale. When Astacio said she’d buy the gun somewhere else, the Greece manager called the store in Henrietta to alert them.

Shortly after, Astacio attempted to purchase Maverick 88 .12-gauge shotgun.  A manager was called to the sales desk and explained to Astacio that the store can deny the sale of a weapon for any reason.

Under the terms of her probation, Astacio is restricted from having a “firearm, dangerous weapon or noxious substance.” Astacio was put on probation following her arrest for drunk driving.

While she is still a judge, she hasn’t shown up for work in weeks, but still gets a paycheck. She could be removed by the state Judicial Commission. However, at this time, the commission hasn’t acted on the case.

Astacio was charged with attempted criminal purchase or disposal of a weapon. She was released following arraignment on Tuesday.
