A grand jury in Lubbock indicted Matthew Jay Gutierrez, 33, on Tuesday afternoon for bribery, retaliation and failure to stop & render aid. 

A police report said officers were called to a traffic accident at 66th and Frankford Avenue during the late night of April 1.  Gutierrez was one of the drivers.  At least one person was injured in the crash. 

“I heard [the suspect] to have slurred speech while speaking with me,” an officer wrote in the police report.  “[The suspect] was asked by EMS how much he had to drink tonight. [The suspect] advised, ‘About a 12 pack.’”

Gutierrez was taken into custody and put into the back of a police patrol unit.

“[The suspect] advised he knew the ‘cartel’ in Lubbock and would have my family and me killed. [The suspect] was adamant he knew the cartel and I should not be arresting him,” the officer wrote.

The officer also wrote, “[The suspect] then offered to give me $500 dollars if I were to let him go and drop the charges. [The suspect] advised his dad was in law enforcement and I was in jeopardy of losing my job by arresting him. [The suspect] advised he was well connected within the city.”

Gutierrez was taken to University Medical Center so that officers could take a blood sample as evidence of drunk driving.

The police report also said, “[The suspect] advised he needed to urinate and wanted to show us (myself and other officers) his penis because we were ‘fa***ts.’”

Gutierrez has been held in jail in lieu of bonds totaling $20,000.
