Emiteria Pauda sued Atmos Energy last week and made an allegation that Atmos was to blame for a street collapse. 

Pauda said in her lawsuit that she as a City of Lubbock employee.  She was driving a city-owned pickup truck at the intersection of 105th Street and Peoria Avenue on August 11.  She claimed that the road collapsed under the truck which caused her to be injured. 

Specific injuries were not listed.

The lawsuit said, “Atmos had dug under this road during work done prior to this incident. Upon information and belief, such digging weakened the road, leading to the collapse.”

The lawsuit also said, “No warnings of the weakened road or construction were present.”

Pauda’s lawsuit claimed that Atmos had an “indifference to the rights, safety, or welfare of others.”

Pauda seeks between $100,000 and $200,000 according to the lawsuit.  Atmos has not yet filed its side of the story in court records. 

EverythingLubbock.com invited Atmos to comment.  The company said, “Atmos Energy has not yet received a copy of the lawsuit and had an opportunity to review it.”
