Pedro (Pete) Garcia Jr., 56, broke down in tears Tuesday morning as he faces the punishment phase in the murder trial for local musician, West Garza.

“I’m really sorry for what I did,” Garcia said to the Garza family in Lubbock County Court. “Don’t think for one minute I don’t think about West.”

After a guilty verdict was determined by the grand jury Monday, the punishment phase is expected to be determined Wednesday.  Therefore, Garcia’s Defense attorney focused on the 56-year-old-man as a person instead of his actions in court Tuesday. 

Five of Garcia’s relatives testified on behalf of the defendant: three sisters, a nephew, and a niece.

All argued a change in demeanor once Garcia got divorced. Some stated he was the loving and supportive “Uncle Pete” that would help anyone in need. While others consoled Garcia during a time of depression from the separation.   

A neurological expert also testified brain impairments after an examination withe Garcia.

He claimed Garcia battled depression, anxiety, Obsessive Compulsive Disorder, and different personality traits during the time of the murder. After a brain injury years ago, the expert argued Garcia was not fully in control of his rage or behavior at the time.

He added his actions were a combination on premeditated with “hot-blooded” offense based on his expert opinion and evaluation of Garcia.  

The grand jury will determine what Garcia’s charges will be in the next trial phase.
