CBD oil has been a hot topic with shops popping up all over the state, including Lubbock, but Seminole Police said none of this is legal.
There’s a big gray area regarding the topic of CBD oil and the answer of whether it’s legal or not, depends on who you ask. Seminole Police Chief Bernie Kraft said CBD oils are still illegal in the state of Texas.
“We’re trying to get the information out there. That there’s still a lot of issues with the CBD oil in Texas,” said Kraft.
He decided to look into the CBD products after a business owner asked Kraft if it was legal.
“You don’t see big promotions on it on national TV or anything like that,” said Kraft, “So it’s showing up at spas and the vape shop. That’s where we’re running to because they’ve selling the CBD oil there.”
After he did some research, he posted this on Facebook:
“CBD Oils and cannibis infused products.
Contrary to current popular belief, CBD oils are still illegal in the State of Texas. Due to the wording in the current state law, CBD oil with even a trace of THC can be filed on as a felony Penalty 2 group substance and without THC can be filed as a misdemeanor. The 2018 Farm bill does allow the cultivation of Hemp, but only certain CBD compounds have been approved to be used for “prescribed medical use”. Most of the CBD compounds are still currently listed as a schedule one substance.
So businesses in town might want to rethink advertising and selling the products.
We are awaiting to see what the Texas 86th legislator is going to do, but as of now, the laws have not changed.”

“A lot of the shops that are getting raided are either carrying the synthetic or the .3 THC or higher,” said Jennifer Diaz, the owner of CBD American Shaman of Lubbock, “Again, we don’t carry that in our stores here in Lubbock. That’s why we are legally here and legally allowed to sell it to you.”
She said all of the products she sells don’t have a trace of THC and that her products are meant to help people, not get anyone high.
“It’s overall just liquid gold, is what I like to refer it as. It helps so many people,” said Diaz, “It’s going to help with inflammation, chronic stress, anxiety, any sleep issues, any mood alternating issue, stomach, digestive.”
Chief Kraft said it’s not that he disagrees with the health benefits, he just doesn’t want anyone to get in legal trouble.
“Even the Farm Bill doesn’t legalize CBD oils, if you actually look at the farm bill itself. There’s certain processes that have to be done. It has to be regulated and all that,” said Kraft.
KLBK checked online to see if CBD oil is legal in Texas, but the articles that popped up were unclear.
“I’m just trying to warn people. If you get caught with that, we send it off. It comes back with THC. It’s a felony,” said Kraft.
Diaz said she hasn’t run into any problems while selling CBD oil products (without THC) and doesn’t expect any to come up.
“People actually love our products,” she said, “They come back, month and month again, because it’s helping them. It’s helping their animals. It’s helping their children.”
As of right now, the Lubbock County District Attorney’s office said they haven’t had any cases presented to them regarding CBD oil.
