After a Snyder man accepted a plea agreement for production of child pornography, court documents revealed this is not the first time Virgil Lee Bailey, 36, was accused of committing this crime. Now more of his victims have come forward and asked for a harsher punishment.
This case dates back to 2013 in Muncie, Indiana, with an Affidavit of Probable Cause for Arrest Without Warrant was filed against Bailey. The documents state a mother accused Bailey of molesting her three young boys.
She told Muncie Police that Bailey was at a mutual family member’s house when her children were spending the night. They returned the next day acting inappropriate and later told her Bailey touched them inappropriately and video taped them.
Bailey was arrested for two charges of child molestation and one charge of child solicitation.
Before the case went to trial, the 46th Judicial Circuit Deputy Prosecutor filed a motion to dismiss this case.
In the documents, it states, “that some time ago, Defense reported that the victims’ mother reported she was going to flee the State of Indiana to avoid participating in trial against the Defendant.”
“I went to CPS and went to police,” the victims’ mother said. “They did an investigation and all that stuff. Then they called me back after court and everything and said he’s just got child pornography. They didn’t have enough proof because were too young.”
The mother fled the state and drove to her hometown of Snyder, Texas.
“I left because I was sick and tired of everything and I just wanted to get away,” she said.
The case was dismissed. She said Bailey followed her down to West Texas.
Approximately two years later, child pornography was traced to a house in Snyder. In January, federal agents identified Virgil Lee Bailey, Jr. as the suspect.

Bailey is behind bars at the Terry County Detention Center but will be sentenced at a later date. He could face at least 15 years in prison but no more than 40 years. The victims’ mother said that is not enough, and she wants justice for her children.
“I want justice,” she said. “I think they need to lock him up and throw away the key. He’s just going to get out and do it again.”
