Livesay Gets Prison for Gun Charge, While Daughter’s Death Case Still Pending

Michael Wayne Livesay, 28, of Lubbock was sentenced Friday to more than 3 years in federal prison for being a convicted felon in possession of a firearm. 

Livesay was arrested in September of 2015 after the death of his 3-month-old daughter, Vera Ruth Livesay.  During the investigation of his daughter’s death, police found a loaded handgun in his closet.  Livesay had a previous conviction related to domestic violence.


A police statement from the time said, “Patrol officers responded to a child drowning in a bathtub at 6104 37th Street. When officers arrived, EMS was already on scene and performing CPR on the child.”

A little girl later was pronounced dead.   Official records said Livesay left the girl unattended in a bathtub. 

Livesay was charged for injury to a child after his daughter’s death, and that charge was still pending as of Monday.
