The lawsuit between Dolcefino Consulting and Texas Tech University can continue, according to an email from State District Court Judge Bill Sowder.

Dolcefino Consulting released a copy of the email on Thursday.  It was written to lawyers for Dolcefino and TTU on Wednesday.

The lawsuit will be strictly limited to issues related to the Texas Public Information Act according to the email.  Dolcefino filed suit against Texas Tech in January claiming both a cover-up after the firing of football coach Mike Leach and violations of the public information act.

The judge made it clear, only the public records dispute will continue – not any other claims by Dolcefino.

Leach was fired as the head football coach on December 30, 2009.  The university said he mistreated a player.  Leach denied it.  

Leach sued and lost.  But he hired Dolcefino in an attempt to get $2.4 million that he claims the university still owes him.

Dolcefino made a series of open records requests and claims Tech has illegally withheld some of the records.

The judge wrote in the email, “It appears to the Court that the issues of what to produce and how much to charge for production are not difficult matters and the Court expects reasonableness as opposed to nitpicking to control the ins and outs of this case.” 

The two sides were ordered to agree on a schedule and a trial date.
