Judge Rules Lubbock Does Not Have to Refund Storm Water Fees

A State District Judge on Thursday ruled in favor of the City of Lubbock and against Beck Steel Inc and John Beck.  Beck sued in 2015 – claiming that the city had illegally assessed storm water fees.

Beck not only sought an injunction against the city but also a refund on behalf of his company and all Lubbock residents.  Among other things Beck accused the city of using storm water money to pay down debt on things that were not related to storm water drainage.

The Honorable Paul Davis ruled that “This is a final and appealable judgment and disposes of all claims brought by [Beck] against [Lubbock].”

There are plans to file an appeal.
