Michael Anthony Garcia, 38, would like to get out of jail according to records filed on Wednesday. Garcia was arrested on December 8 for arson and possession of a controlled substance.
On that day, firefighters responded to the 2500 block of 1st Street. A storage area had been intentionally set on fire near a house. A woman and her father were home at the time.
According to an arrest warrant Garcia had been in a dating relationship with the woman.
“Text messages of M. Garcia … [told the victim] that he was going to kill her…,” the arrest warrant said.
Garcia has been held on bonds totaling $82,500.
The request for lower bond on Wednesday said, “The amount of bond is a tool to guarantee the Defendant’s presence in court and not to be used as an instrument of oppression.”
“The defendant is not a continuing danger to society and … he will appear in court as scheduled,” the request said.
Garcia’s attorney, Audie Reese, would like the bond to be lowered down to $1,000.00. The request was filed in the 364th District Court. Presumably, the Honorable William R. Eichman II, would make a ruling.
As of Thursday afternoon, no hearing had been scheduled and no ruling had been made.
