A routine check of public records on Wednesday revealed a search warrant related to a case of manslaughter in Lubbock County. Kenneth Lee Cate, 56, was arrested on October 5 for the shooting death of David Perez, 55.
Deputies with the Lubbock County Sheriff’s Office were called to the 8500 block of North County Road 2600. Three men were firing guns, and deputies were told Perez stepped in front of Cate while he was firing a .380 handgun.
Court records described a gunshot wound to Perez’ abdomen. EMS pronounced Perez dead at the scene.
A search warrant in the case said, “There was a strong odor of an alcoholic beverage coming from Kenneth’s person. Kenneth said he, [another man] and David were drinking alcohol while the shooting took place.”
The search warrant allowed deputies to take firearms, ammunition, surveillance equipment and surveillance files. Deputies believe there was surveillance video of the shooting according to court records.
Cate was held Wednesday in the Lubbock County Detention Center on a $100,000 bond.
