A Lubbock County grand jury on Tuesday indicted both a father and son for murder.
Abel Rosales, Jr., 22, and Abel Rosales, Sr., 49, were arrested on September 14, which was two days after the shooting death of Gabriel Rodriguez, 36.
A police report said officers were called to a home at the intersection of North Detroit Avenue and Baylor Street. Rodriguez was found inside with a gunshot wound. He was taken to University Medical Center where he later died.
His brother, Elias Rodriguez, 34, had been hit over the head with a pipe. He recovered and was released from UMC. An arrest warrant said the gun used by Abel Rosales, Jr., malfunctioned otherwise both brothers might have been shot.
The victim’s family said an argument over a lawn mower led to the dispute.
Both father and son remained in the Lubbock County Detention Center on Tuesday. Bonds were set at $500,000 for each on a murder charge.
