LUBBOCK, Texas — Charles Flournoy, 25, is the focus of Child Protective Services once again. Court records released last Thursday stated that CPS wants custody of his infant son.

This newest CPS case was filed as a non-emergency, and is still pending. There is a court hearing on April 30. CPS believes that Flournoy’s newborn son is unsafe, and the agency would like to retain custody.

CPS said the child is believed to be unsafe because “previous drug history and current allegations of drug abuse, domestic violence, previous history with the Department, including child death, lack of cooperation from the parents, and the age of this child.” 

Back in 2015, Flournoy was arrested and charged with injury to a child after police and EMS responded to the report of a 1-year-old not breathing. Flournoy later posted bail while the mother of the child, Madison Rodriguez, age 18 at the time, was charged with capital murder and still remains behind bars. 

Flournoy said that he was taking a shower while the 1-year-old was playing with his toys, according to court records. When he got out of the shower, Flournoy said he found the child unresponsive. Flournoy told investigators that he then proceeded to give the child CPR and passed out from shock. He also stated his father then took over CPR until EMS arrived, as indicated by court records. 

Court records stated that an autopsy revealed the child had been thrown to the ground during an altercation and died of blunt force trauma. The case was ruled as a homicide. 

The 2015 criminal case is still pending.
