A jury found Nicholas Fisher, 26, of Lubbock guilty of aggravated assault on Wednesday morning.  He was sentenced by the same jury to 11 years in prison.

According to an indictment, Fisher used a knife to attack Alyssa Carothers.  More specifically, a police report said he stabbed her in the back in the 7400 block of Elm Avenue.  The police report said he also hit her in the face with his fist.

The police report said Fisher was angry that Carothers did not get gas money from her brother. A resident of the neighborhood saw the attack, called police and told Fisher that police were on the way. The police report said Fisher left.

The defense claimed there was no evidence that Carothers’ injury was caused by a knife. Prosecutors presented photographs in court showing blood on the victim’s hand and back.

Prosecutors also said Carothers’ story was consistent at the time and five days later that her boyfriend stabbed her in the back with a knife.

Ultimately the jury believed Carothers instead of Fisher.
