A Lubbock woman sued the City of Lubbock and a police officer on Tuesday. Lynn Frame claimed in her lawsuit that the Lubbock Police Department destroyed computers, a thumb drive, a hard drive and an iPhone that belonged to her.
The lawsuit seeks between $200,000 and $1 million.
The lawsuit said police arrested her husband, and seized the property. Criminal court records from September of 2017 said Richard Dickerson was sentenced to 90 days in jail plus probation for indecency. He was accused of exposing himself to two underage girls.
Before Dickerson was sentenced, his attorney asked prosecutors to give back the seized property.
The lawsuit said, “The Assistant District Attorney investigated the location of the property, and subsequently revealed, on or about August 1, 2017, that the property no longer existed, having been destroyed during the pendency of the criminal case that the property was evidence in.”
The lawsuit said Frame lost the computer property, but also lost several years of “irreplaceable” professional data from years of medical research.
The lawsuit said “[Frame] understands that the Silver Macbook Pro was returned to Texas Tech University, who was the owner of that computer.”
EverythingLubbock.com has requested information to confirm Frame’s place of employment.
The lawsuit claimed police violated the Texas Constitution and the US Constitution by “destruction and defalcation of the property.”
The police department does not comment on pending lawsuits.
