The CBS television affiliate in Dallas reported that Armando Luis Juarez, 29, was patted down for weapons before shooting two police officers and wounding a third person.

A handgun was missed in the pat-down, according to dfw.cbslocal.com.  

The shooting was Tuesday afternoon at a location of Home Depot.  Juarez was found and arrested Tuesday night. 

Officials in Dallas on Wednesday morning said Officer Rogelio Santander died. At last check, Dallas Police Officer Crystal Almeida and Home Depot’s loss prevention officer Scott Painter remained hospitalized.

Dfw.cbslocal.com said, “Sources say Juarez was frisked before he was led without handcuffs into a room with three people who would all be shot shortly after.”

“But sources say Juarez was not cuffed and the off-duty officer failed to detect the handgun in his pocket during a pat down,” dfw.cbslocal.com also said.

If so, the case bears a striking parallel to the shooting death of a police officer on the campus of Texas Tech University on October 9.  Officer Floyd East was alone in a room with Hollis Daniels inside the police station at Texas Tech. 

Court records said Daniels had been frisked before he was taken to the police station.  Nevertheless, Daniels was able to use a stolen gun to shoot and kill East, according to court records. 

In the Lubbock case, court records said, “Daniels removed the Springfield XD 45 caliber pistol from his pants and executed Officer East by shooting him in the head.”

Daniels was not handcuffed at the time. 

Daniels remained Wednesday in the Lubbock County Detention Center for capital murder.  Juarez’s charges were upgraded Wednesday to capital murder after the death of officer Santander.
