Prosecutors filed a request on Friday afternoon to seize a 2001 BMW from Hollis Alvin Daniels, 19, who is accused of shooting and killing a police officer on the campus of Texas Tech University.
The court records filed in the seizure case provide a few clarifications of details already reported from the October 9 shooting and killing of Floyd East, Jr., 48.
The seizure case said Daniels stole a firearm on October 8 in Central Lubbock and used the BMW to leave the scene of the theft. Daniels has been indicted since then on a federal charge of possessing a stolen firearm.
The seizure case also said, “On October 9th, 2017, Texas Tech Police Officers East and Snelson were called to Daniels suite at 1803 Boston Avenue, Talkington Dormitory #134C in reference to a welfare check due to complaints from Daniels’ suitemates that they had heard a gunshot from Daniels’ suite around 3 AM on the 9th.”
“Officers located Daniels and patted him down for officer safety upon contact with him and did not locate a weapon at that time,” court records said.
Officers found drugs and took Daniels into custody for drug possession. Daniels was then taken to the Texas Tech police station.
“During this time, while Daniels and Officer East were in a room alone, Daniels removed the Springfield XD 45 caliber pistol from his pants and executed Officer East by shooting him in the head,” court records said.
Daniels ran out of the Texas Tech police station. He was arrested less than two hours later. The stolen gun was also found. Daniels has been in the Lubbock County Detention Center since that time.

SECTION E — NARRATIVE
On October 8th, 2017, a report was made to the Lubbock Police Department in reference to the theft of a firearm from a residence. Lubbock Police Department case number 17-34599 was assigned to this offense. xxx xxxxx reported that he had a Springfield Arms XD .45 caliber pistol that his brother had gifted to him. xxxxx advised that he kept the pistol on a shelf by his bed in the nightstand. He advised that the gun was in plain view if you stood in his bedroom and looked at the nightstand. xxxxx advised that he arrived his residence about 10:00 PM and that Daniels was already there. xxxxx advised that Daniels’ BMW SUV was at the residence. This is the only vehicle that xxxxx knows Daniels to drive. xxxxx advised that several of the people at the residence were in the back yard smoking and Daniels suddenly left the house without saying anything to anyone. xxxxx went to his bedroom about 12:30AM and immediately noticed his gun was missing. xxxxx spoke to a friend, xxxxx xxxxxxxxxxx and xxxxxxxxxxx advised that he had caught Daniels going into xxxxx’s room earlier that evening. xxxxxxxxxxx asked Daniels what he was doing in there and Daniels replied that he was just looking around, looking for the bathroom. xxxxx advised Daniels has been to the residence on other occasions and would know where the bathroom is located. xxxxx advised that he went outside and Daniels was gone as was his BMW.
xxxxx called Daniels on the phone to ask if Daniels had his (xxxxx) gun. Daniels denied having it and returned to the residence to talk to xxxxx about it. Daniels continued to deny having the gun and became angry when confronted about it. Daniels told xxxxx “if I had your gun I would use it to kill you and then shoot myself.” Daniels at one point during the argument, Daniels reached into his waistband in a threatening manner and xxxxx believed that he had the firearm there. Daniels commented to that he doesn’t fight fair, he fights dirty”. Daniels eventually left and xxxxx called the Lubbock Police to report the theft.
Lubbock Police Officers Duckworth and Dukatnik responded to the call. Officer Duckworth located Daniels driving the Silver BMW north on Indiana Avenue and conducted a stop of the vehicle. Officer Duckworth conducted a pat down of Daniels for officer safety and advised him of the reason for the stop. Officer Duckworth advised that Daniels denied any weapons in the vehicle and was adamant that his vehicle not be searched. Officer Duckworth detained Daniels, but he was eventually released from the scene.
On October 9th, 2017, Texas Tech Police Officers East and Snelson were called to Daniels suite at 1803 Boston Avenue, Talkington Dormitory #134C in reference to a welfare check due to complaints from Daniels’ suitemates that they had heard a gunshot from Daniels’ suite around 3 AM on the 9th. Officers located Daniels and patted him down for officer safety upon contact with him and did not locate a weapon at that time. Daniels gave Officers East and Snelson consent to search his suite. Officers Snelson and East located suspected Xanax pills and a small quantity of marijuana along with drug paraphernalia on Daniels’ person and in his suite and placed him under arrest. Daniels was transported to the Texas Tech Police Department for completion of arrest paperwork. During this time, while Daniels and Officer East were in a room alone, Daniels removed the Springfield XD 45 caliber pistol from his pants and executed Officer East by shooting him in the head. Daniels fled the police station on foot and hid the pistol in a box that was taken from his room by Officers East and Snelson. After being on the run for approximately 90 minutes, Daniels was finally located and taken into custody. A subsequent search of the area located the Springfield XD 45 pistol and it was confirmed that this was the same firearm that Daniels had stolen from xxxxx. Daniels was charged with Capital Murder of a Police Officer and subsequently federally indicted in the United States Federal Court, for the Northern District of Texas for being in possession of a stolen firearm.
On August 8th, 2017, Daniels was stopped by the Seguine, Texas Police Department and arrested for an outstanding warrant. At the time of this stop, Daniels was the driver of the listed silver BMW X5. Seguine Police Department Incident number 1700041919.
