Hollis Alvin Daniels, 19, was indicted Wednesday by a federal grand jury for possession of a stolen firearm. Daniels is the same defendant who was arrested Monday night for the murder of a police officer on the campus of Texas Tech University.
Daniels shot and killed Floyd East, Jr. according to court records. He was held Wednesday in the Lubbock County Detention Center for capital murder. Officials have not said if state prosecutors might seek the death penalty.
It is not clear if the state prosecutors would have to wait for the outcome of the federal case before proceeding with the capital murder case.
Court records in the capital murder case said Daniels was taken into custody Monday evening and was in the Texas Tech police station. Daniels was alone in a room with East and was not handcuffed. Court records said he had a handgun and shot East.
Officials have not said if Daniels was frisked for a weapon before he was taken to the TTU police station. Daniels ran away after the shooting. Officers found him a little more than 90 minutes after the shooting and arrested him.
Texas Tech police did a welfare check on Daniels after his family notified officials that they were worried he might be suicidal and have a gun. Police found drugs in his dorm room and he was taken into custody for that reason.
A federal court date was not yet listed in official records.
