Michael Wayne Livesay, 28, the Lubbock man accused of injury to a child for the death of his 3-month-old daughter last year, pleaded guilty Wednesday for an unrelated firearms charge.
Shortly after the death of his daughter, he was also charged as a convicted felon in possession of a firearm. His previous conviction was for domestic violence in 2008.
According to court documents, he admitted in federal court to possessing the firearm.
In September of last year, Lubbock Police searched Livesay’s home in the 6100 block of 37th Street. Police had been called to the home for an unresponsive child. According to police, Livesay told officers he left Vera Ruth Livesay unattended in a bathtub. While investigating his daughter’s death, officers found a loaded handgun in his closet.
Livesay will be sentenced for the federal firearms conviction at a later date to no more than 10 years in prison.
Meanwhile, the criminal charge for the death of his daughter was still pending as of Wednesday in state court.
Livesay was held on bonds totaling $75,000 in the Lubbock County Detention Center.
