A Lubbock County grand jury on Tuesday indicted Johnny Martinez, 41, of Lubbock for two counts of sexual assault.  An arrest warrant was issued for Martinez on February 3 – claiming that he sexually assaulted a woman on August 21, 2015. 

He was also listed in jail records as Juan Ramon Martinez.

According to the arrest warrant, the woman went to Martinez’ residence to get a tattoo on her hip, pelvis and right leg. 

“At some point she had to remove her underwear due to the area that the tattoo was going to cover,” the arrest warrant said.

Martinez had given her hydrocodone and vodka, according to the arrest warrant.

At about 4:00 a.m. she fell asleep as Martinez was working on the tattoo.  According to the arrest warrant, she woke up at 8:00 a.m. with Martinez penetrating her with his finger. 

She pushed him away, and according to the warrant he took her home.  She reported the incident to police a few days later.

The second indictment was for a case in November of 2014.  A different woman had come forward to police but there were similarities in the two stories.

A police report said, “[The victim] advised [Martinez] was tattooing her hip when she felt him insert two of his fingers into her vagina. [The victim] told [Martinez] to stop but [he] ignored her. [The victim’s] dad transported her to the UMC ER for evaluation.”

Martinez was in jail Wednesday morning on bonds totaling $400,000.  His previous record includes arrests for retaliation, robbery and attempted murder.
