A Lubbock County jury on Wednesday found Jeremy Jackson, 35, of Lubbock not guilty of aggravated assault. Jackson was indicted for a jet ski accident that seriously injured Dustin Lambright at Buffalo Springs Lake in 2012.
Prosecutors argued that Jackson was intoxicated. One of the lesser charges presented in the case was boating while intoxicated.
“Obviously we’re happy with the verdict,” said Jackson’s defense attorney, Nick Olguin. “The State didn’t establish that my client was reckless in this case.”
“I really think the jury had a good grasp on that and I think that it was a good verdict and we’re very happy about that.”
Olguin said video evidence presented during the trial showed that Jackson was remorseful, and he didn’t mean for the accident to happen.
“It was an accident and that’s what we’ve been saying all along,” Olguin said.
Olguin said Jackson performed field sobriety tests well. Olguin did not deny that Jackson had consumed alcohol. However, he said Jackson walked straight and had clear speech after the accident.
