Lubbock Police believe a crash Sunday night along Interstate 27 at 50th Street was actually an aggravated assault.

Police arrested Joe Anthony Garcia, Jr., 19, of Lubbock.  When police first arrived, there was a crashed car, and nearby Garcia and a child were sitting along the side of the Interstate.

An officer wrote in a police report, “[Garcia] advised me that he was stupid.”

“I asked [Garcia] to elaborate,” the police report said.  “[Garcia] advised me that he and [his girlfriend] were involved in a verbal argument while driving home from Joyland.”

The report said the girlfriend was driving and Garcia was in the front-passenger seat.

“[Garcia] advised that he grabbed the steering wheel and pulled it towards him causing the vehicle to lose control,” the report said.  “[Garcia] advised that [his girlfriend] attempted to overcorrect the vehicle causing it to crash into the retaining wall on the west side of the highway.”

The girlfriend gave a similar account. 

A police report described the injuries as minor.  Garcia was held Monday in the Lubbock County Detention Center on bonds totaling $15,000.  His charges were aggravated assault and injury to a child by criminal negligence.
