Danny Wayne Burks, 47, of Lubbock was indicted Tuesday for injury to a child.
Officials said Burks had a dispute with a neighbor over music. He shared a balcony with another resident in the 6500 block of Avenue T. During the dispute Burks was accused of pushing a kid’s head into a wall and briefly choking him.
According to officials, the kid had Down syndrome. The condition can cause mild to moderate intellectual disability. The age and gender of the child were not revealed in the police report. The extent of injury was also not listed.
Burks was arrested right after the incident on June 12. He was held Tuesday in lieu of a $2,500 bond.
