Ninth Judicial District Attorney, Andrea Reeb, announced that David Brown, age 55, of Melrose, NM, was sentenced for the criminal sexual penetration of an 18 year old woman.
In January, 2015, after a three day trial, a Curry County jury found Brown guilty of Criminal Sexual Penetration, a third degree felony.
The victim was 18 years old at the time of the assault which occurred in Melrose in December of 2010. The crime was committed when Brown knew that the victim was medicated and incapable of consenting to sexual intercourse.
The Honorable Stephen K. Quinn presided over the sentencing hearing yesterday and sentenced Brown to three years in prison, with 18 months of that time suspended in favor of supervised probation. Brown is required to register as a life time sex offender and upon release from prison serve parole of not less than five years and up to 20 years.
The case was prosecuted by Chief Deputy District Attorney Brian S. Stover. Criminal Defense Attorney, John Samore, of Albuquerque, represented the defendant.
