The owner of the plane crashed by pilot Clayton Chennault said the pilot did not have permission to use the plane during nighttime hours, including at the time of the fatal crash on June 1.

YourBasin.com reported on Tuesday that the owner of the plane, Larry Mercer, reported the aircraft as stolen, but did not file charges.

Midland Police confirmed that Chennault was the only one killed in the plane crash.

The pilot’s fiancée, Cathy Mote, called police that night at 9:07 p.m. at Basin Aviation at 901 Veterans Airpark Lane, according to Midland Police.

She said Chennault contacted her that night around 8 p.m., and YourBasin.com said he also called other family members. The family said they believe the crash happened at 8:45 p.m.

Chennault’s fiancée also reached out to Mercer and told him about the situation.

The NTSB is investigating the crash at this time.  However, a preliminary NTSB report was not available as of Wednesday.
