Two McDonald’s customers are suing the burger giant after they say the business overcharged for their order.
They said they had to pay for a quarter pounder with cheese, even though they ordered the sandwich without cheese.
Fox News reports Cynthia Kissner and Leonard Werner are arguing that McDonald’s prices burgers differently according to whether or not it has cheese on it. But they say when they ordered a Quarter Pounder without cheese, they are charged as if it did have cheese on it.
The lawsuit states McDonald’s used to offer a Quarter Pounder without cheese that was between 30 to 90 cents cheaper, but it has since removed that option from the menu.
The lawsuit states the two people “have suffered injury as a result of their purchases because they were overcharged, and were required to pay for cheese, which is not a component of either a Quarter Pounder or a Double Quarter Pounder, that they did not want and did not receive,” according to Fox News.
The pair is asking for $5 million.
A McDonald’s spokesperson told USA Today, “We do not believe the claims in this lawsuit have legal merit. The advertised Quarter Pounder burger comes with cheese. We try to accommodate our customers’ requests by allowing them to customize their orders, such as a Quarter Pounder with no cheese.”
