Odessa Police arrested and charged a man on Thursday after he reportedly performed a sexual act on a woman while she was asleep, according to a probable cause affidavit.
Back in April a woman made a complaint to the OPD and said that she had been sexually assault by Billy Ray Don Allen earlier that day, according to the affidavit.
The woman said Allen and several others were at her home the night before drinking and towards the end of the night everyone went to bed, according to the affidavit.
At that point Allen reportedly entered her spare bedroom where she was sleeping and performed a sexual act on her while she was asleep.
The woman reportedly began yelling and told Allen to leave.
A witness later took the woman to the hospital to report the assault where a SANE exam was conducted, according to the affidavit.
The exam was reportedly consistent with the report the victim made to police.
OPD and the U.S. Marshal Service arrested Allen at about 10:25 a.m. Thursday in the area of 34th Street and West County Road.
He has been charged with sexual assault, a second degree felony.
