The following is a press release from Ninth Judicial District Attorney:
Ninth Judicial District Attorney, Andrea Reeb, announced that on August 22, 2018, a Curry County jury found David Garcia, age 46, of Clovis, guilty of Criminal Sexual Contact of a Minor under the age of 13, a third degree felony. The jury deliberated 45 minutes before returning their verdict.
The incident occurred at David Garcia’s home, in October of 2014, where the victim was spending the night. The victim disclosed what had happened to her grandmother in January of 2015.
The Honorable Drew Tatum presided over the one-day trial and ordered that the defendant be remanded into custody pending sentencing to be held at a later date. Garcia is facing up to six years in prison, lifetime sex offender registration, and twenty years on probation.
Brian Scott Stover, Chief Deputy District Attorney, and Kristen Beltran, Assistant District Attorney prosecuted the case for the State. Jonathan Miller, Criminal Defense Attorney, of Albuquerque, represented Garcia.
