The following is a news release from the New Mexico Ninth Judicial District Attorney’s Office:

Ninth Judicial District Attorney, Andrea Reeb, announced that today a Curry County jury found Elvis Gaytan, age 28, of Clovis, guilty of criminal sexual contact of a child under the age of 13, a second degree felony for a sexual offense against a child.

In November of 2017, the victim reported to her mother that she had been sexually assaulted by a close family friend. The child disclosed more information later at The Oasis, a safe house interview. Gaytan was arrested a few days later.

The Honorable Matthew Chandler presided over the two-day trial and ordered that Gaytan be taken into immediate custody pending a sentencing hearing.  Gaytan faces up to 15 years in the New Mexico Department of Corrections and a lifetime registration as a sex offender.

The case was prosecuted for the State by Brian Stover, Deputy District Attorney, and Gaytan was represented by Criminal Defense Attorney, Benjamin Herrmann.
